MTSBU begins settlement of insurance claims under the obligations of PrJSC «ST «Illichivske» under contracts of compulsory insurance of civil liability of owners of land vehicles in terms of compensation for damage caused to the life, health and property of injured individuals. Compensation for unfulfilled obligations of the insurer will be made within the balance of the basic guarantee contribution of PrJSC "ST "Illichivske" in the MTIBU Victims' Protection Fund (FZP).
Acceptance of documents of victims in road accidents under the obligations of PrJSC "ST "Illichivske" will be carried out in the period from October 1, 2018 to December 31, 2018. Documents can be submitted in person, at the address - Kyiv, Rusanivskyi Boulevard, building. 8, send by mail to the address - 02002, Kyiv-2, P.O. Box 272 or send by e-mail to [email protected].
Payments of insurance compensation will be made taking into account the following:
- the application for payment of insurance compensation is submitted by the individual victim or his legal representative or heir;
- the insurance contract was concluded with PrJSC «ST «Illichivske» no later than 06.12.2016, the start of such contract no later than 06.12.2016;
- damage was caused to the life, health or property of the victim – individual;
- the recipient of payments is exclusively the victims – individuals who have suffered damage, their legal representatives or heirs;
- insurance payments are made based on applications received by MTIBU by December 31, 2018;
- insurance compensation payments for damage caused to the life and health of the victim are made in full;
- insurance compensation payments for damage caused to the property of victims-individuals are made in the amount of the estimated damage, but not higher than the maximum amount of insurance compensation payment per victim.
In order for MTIBU to make a decision on insurance compensation, the following must be attached to the application for compensation for damage:
- a copy of the court decision on the collection of insurance compensation or compensation for damage - if the dispute regarding the payment of insurance compensation or compensation for damage was considered in court and a decision was made to satisfy the claim;
- original or certified copy of the letter from the authority enforcement service regarding the results of the execution of the court decision - if an application for compulsory execution of the court decision was filed;
- written justification and supporting documents regarding the reasons for not filing an application for compulsory execution of the court decision - if the dispute regarding the payment of insurance compensation or compensation for damage was considered in court and a decision was made to satisfy the claim, but an application for compulsory execution of such a decision was not filed;
- a copy of the court resolution certified by the court on bringing to administrative liability the person whose civil liability is insured (its employee) or another document confirming the existence of grounds for the occurrence of civil liability of such a person, as well as originals or duly certified copies of documents on the basis of which the amount of damage was assessed - if disputes regarding the payment of insurance compensation or recovery of losses from the responsible person were not considered in court.
- documentary confirmation of the existence of a policy compulsory third party liability insurance of vehicle owners, under which payment may be made, – in the absence of information in the unified centralized database of MTIBU confirming the presence and validity of such an insurance policy on the date of the relevant road accident.
The maximum amount of compensation for the obligations of PrJSC «ST «Illichivske» per victim will be determined by the Presidium of MTIBU, taking into account the applications received by MTIBU, which are accepted for consideration and recognized by MTIBU, the amount of the available balance of the insurer's guarantee contributions to the FZP.
