Deputies have registered a bill that is designed to increase the size of insurance amounts to European standards. Accordingly, the cost of policies will also increase.
The Verkhovna Rada of Ukraine has registered the draft Law No. 3670-d dated 02/13/2018 "On Compulsory Civil Liability Insurance of Owners of Land Vehicles". This is a new law on motor insurance, which is intended to replace the old one, which has been in effect since 2005 and has been amended many times.
The new draft Law proposes to introduce several progressive norms that will make the "motor insurance" more civilized, and payments under it will be faster and guaranteed even in the event of the insurer's bankruptcy. However, the other side of the coin - increasing the cost of the policy for the car owner.
In particular, the bill proposes:
- Step by step increase the insurance amounts to the level of the European Union countries, and then introduce a gradual deregulation of the determination of the insurance payment to the market.
- Introduce the conclusion of a contract of compulsory civil liability insurance of owners of land vehicles in electronic form. At the same time, provide for a transitional stage that will allow, within a year after the entry into force of the Law, to ensure the possibility of concluding a contract of compulsory civil liability insurance of owners of land vehicles in both electronic and paper forms.
- The introduction of an electronic policy will allow the relevant units of the National Police to check the presence of a valid contract with the driver by querying such a database and does not force the driver to carry a paper policy with him. This will also eliminate the possibility for bankrupt insurance companies to continue selling policies, misleading people.
- Implement a system of direct settlement of insurance cases in which the insurer that insured the civil liability of the victim performs the duties of the insurer that insured the civil liability of the person who caused the damage (in terms of providing insurance compensation in connection with damage or physical destruction of the victim's vehicle).
- Simplify the procedure for reporting a road accident, introduce clear regulations and time limits for making a decision on providing insurance compensation and its payment.
- Regulate the procedure for assessing the amount of the victim's losses by introducing a damage report - a document that confirms the amount of the estimated loss in accordance with the Law of Ukraine "On Valuation of Property and Property Rights" and the Law of Ukraine "On Forensic Expertise".
- Increase the insurer's liability for violation of the terms of payment of insurance compensation (regular payment) due to the fault of the insurer to a person who is entitled to receive such compensation.
- Regulate the mechanism for the insurer to compensate the expenses of a person whose liability is insured.
- Identify additional grounds for the MTIBU to make regulatory payments under compulsory civil liability insurance contracts.
- Implement the requirements of the European Directive in terms of creating a single information center that any person (regardless of which insurance company they are insured with) can contact for consultation and information. It is proposed to grant such rights and functions to MTIBU as a self-regulatory organization of market participants.
- To harmonize the terminology of the Law with the Civil Code of Ukraine, taking into account judicial practice, in order to prevent ambiguous interpretation of the norms of the Law by the courts.
